These Terms of Service (“Terms”) govern all bookings and participation in tours operated by Signature Black Hills Tours, LLC (“Company,” “we,” “us,” or “our”). By booking a tour or participating in any activity, you agree to these Terms.

Reservations & Payment

Reservations are confirmed upon receipt of full payment unless otherwise agreed in writing. Tour dates are not held without payment.

Payments are processed securely through Stripe. By submitting payment, you confirm that you are authorized to use the payment method provided.

We reserve the right to cancel or refuse any booking at our discretion.

Cancellation & Refund Policy

Free cancellation is permitted up to 72 hours (3 days) prior to scheduled departure time.

Cancellations made within 72 hours of departure are non-refundable.

Failure to appear at the scheduled departure time (“no-show”) is non-refundable.

All cancellation requests must be submitted in writing via email.

Any non-refundable processing or transaction fees may be deducted from refunded amounts.

We strongly recommend purchasing travel insurance to protect against unforeseen circumstances including illness, flight delays, weather disruptions, or last-minute changes.

Rescheduling

Requests to reschedule must be made at least 72 hours prior to departure and are subject to availability.

We are not obligated to reschedule bookings within 72 hours of departure.

Late Arrivals

Tours depart promptly at the scheduled time and conclude at the scheduled end time.

Guests arriving more than 30 minutes late without prior communication may be considered a no-show and are not eligible for a refund.

Weather & Operational Adjustments

Your safety and experience are our top priorities.

Tours operate rain or shine. Itineraries may be modified due to weather, road conditions, wildlife activity, seasonal closures, guest pacing, or other safety considerations.

Refunds are not issued for weather that is uncomfortable but safe.

Signature Black Hills Tours reserves the right to cancel, delay, modify, or adjust a tour due to severe weather, road closures, mechanical issues, guide illness, government restrictions, or other circumstances beyond our control.

If we cancel a tour, guests will receive either a full refund or the option to reschedule at no additional cost.

Park access, wildlife sightings, and specific viewpoints cannot be guaranteed.

Waiver Requirement

All participants are required to complete and electronically sign our Liability Waiver through Smartwaiver prior to participation.

Failure to complete the required waiver may result in denial of participation without refund.

The signed waiver governs assumption of risk and release of liability.

Participant Responsibility

Participants must follow all guide instructions and comply with safety and park regulations.

We reserve the right to remove any participant whose behavior is unsafe, disruptive, or unlawful. No refund will be provided in such cases.

Assumption of Risk

Participation in guided outdoor tours involves inherent risks, including but not limited to uneven terrain, wildlife encounters, weather exposure, vehicle transportation, and physical activity.

By participating, you acknowledge and accept these risks as further outlined in the signed Liability Waiver.

Chargebacks & Payment Disputes

By booking a tour, you agree to contact us directly to resolve any concerns prior to initiating a payment dispute.

Improper chargebacks may result in recovery of associated fees and costs to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Signature Black Hills Tours, LLC shall not be liable for indirect, incidental, special, or consequential damages arising from participation in our tours.

Nothing in these Terms limits liability for gross negligence, recklessness, or willful misconduct where prohibited by law.

Governing Law & Venue

These Terms shall be governed by the laws of the State of South Dakota.

Any legal action shall be brought exclusively in the State of South Dakota.

Entire Agreement

These Terms, together with the signed Liability Waiver, constitute the entire agreement between the parties.

We strongly recommend that all guests purchase comprehensive Travel Insurance to protect their investment against last-minute flight cancellations, illness, or personal emergencies that may prevent them from attending their tour.
